Workplace mediation

Micro management aggressions are becoming increasingly common within the workplace. We have helped resolve an employee’s issues with management from becoming a potential grievous claim and possible tribunal proceedings.

Mediation outcome
Resolving the issues resulted in management taking continuous professional development to improve their management skills and the organisation avoiding hefty cost implications.

Neighbour mediation

When a couple moved into a shared ownership apartment in Battersea, difficulties arose when their neighbours dog barked incessantly. The problems continued over a period of 17 months. Mediation took place over one day with separate meetings taking place in the parties’ homes.

Mediation outcome

It was established that the neighbour was keeping a rescue dog that was suffering from a type of trauma. Eventually it was agreed that the dog required treatment therapy. The couple also received an apology. It was also agreed that any future problems should be addressed immediately between the parties.

After 12 weeks, a follow up mediation session took place and the dog’s barking had ceased. Court proceedings and costs were avoided and a fragile neighbourly relationship restored.

Contractual mediation

This three-way veterinary partnership required mediation following the breakdown of their relationship. Two of the partners wished to continue with the partnership without the involvement of the third.

However, the third partner had no desire to leave the partnership as he believed that he still had a significant role to play and had several concerns about the future financing of the partnership. There were also counter allegations of bullying, allegations of procedural irregularities, and concern for costs if the matter proceeded to court.

Mediation outcome
Mediation resulted in a final settlement where progressive discussions and decisions were made with a follow up session after 12 weeks.

Shareholding dispute

A dispute arose between two sisters who were directors and shareholders of a catering business due to a breach of a shareholder’s agreement. The dispute had become very intense, to the point of near insolvency of the business.

The sisters were concerned about the risk to creditors, a sum which was in excess of £96,000, and hired us for mediation in order to avoid this problem.

Mediation outcome
Following mediation the sisters resolved their issue which allowed them to work on creating effective solutions for their creditors.

Property mediation

We mediated a contractual dispute where the commercial landlord leased industrial premises to the tenant under a 5 year lease with no break clause. After a year, the tenant ceased payment of the rent citing disrepair and damage to the premises causing losses and machinery damage. The matter escalated to the point of potential court proceedings.

Mediation outcome
When we were hired to undertake mediation, the issues between the landlord and tenant were resolved. This resulted in a settlement being reached for the damage to the machinery, which was set against the rent owed. Consequently, this meant that they avoided potential forfeiture of the lease and costly court hearings, which would have been in excess of £15,000 each.

Clinical negligence mediation

Clinical negligence was alleged by a couple against a hospital Trust. A junior doctor failed to diagnose that the wife was suffering with an ectopic pregnancy and not food poisoning. This resulted in a second trip to the hospital and the need for an emergency lifesaving operation and subsequent loss of a fallopian tube. For 16 months the couple had been seeking an apology from the hospital and had run up a legal bill in excess of £8,000 and court action.

Mediation outcome
Following one day of mediation, the matter was settled with the Trust agreeing to issue an apology for inconveniences and stress caused. They also gave details of action they would take to address the issues set out in the wife’s letter and how to manage their patient services better.

Managed moves school mediation

We acted as mediators in a dispute between a school and a parent and child. The child had been exposed to bullying in school. The relationship between the parent and the school had deteriorated over a period of time.

The parent was reluctant to return the child back to school. Mediation enabled both sides to agree to a settlement of the dispute whereby a managed move was offered to the child. The managed move was successfully completed to another school. The agreement highlighted the importance of getting the child back into education and eradicated the parent’s anxieties about the child’s safety and wellbeing.
